Les institutions tunisiennes Al Imtithal et ASTECIS ont remporté l’appel d’offres lancé par l’AAOIFI pour la traduction en langue française de ses Shari’ah Standards. La traduction en français de l’ensemble des standards de l’AAOIFI devra être accomplie dans un délai de 7 mois, soit l’été 2017.
Cette démarche s’inscrit dans le cadre des efforts de l’AAOIFI pour la diffusion de ses Shari’ah Standards, qui sont devenus la principale compilation de jugements de Fiqh contemporain dans le domaine de Fiqh al Mouamalat (jurisprudence des transactions financières) au niveau mondial.
Les standards de l’AAOIFI, actuellement au nombre de 54, sont largement populaires au niveau global de la finance islamique, et sont considérés comme la principale référence de cette industrie pour les instances législatives, les autorités de régulation, les institutions financières, et les autres instances professionnelles telles que les cabinets d’avocats, les cabinets d’experts comptables et de conseil, ainsi que les universités, les centres de recherche et les Sharia boards.
Eu égard à la taille des communautés francophones dans le monde, réparties sur plus de 54 pays sur les cinq continents, et alors que la finance islamique se développe rapidement en Afrique du Nord et de l’Ouest et dans d’autres pays francophones, l’AAOIFI a entrepris de faire traduire ses Shari’ah Standards en français selon une méthodologie rigoureuse pour assurer une traduction une traduction fiable comportant plusieurs niveaux de révision, d’édition et d’assurance qualité pour obtenir une édition française qui reflète fidèlement la connotation arabe de ces standards.
L’AAOIFI a chargé les prestataires sélectionnés de traduire les Shari’ah Standards de l’AAOIFI (54 volumes) de l’Arabe au Français, conformément aux Termes de Référence téléchargeables ci-dessous.

Clarifications – RFP – translation of AAOIFI’s Sharia Standards from Arabic to French
Dear all,
With reference to the RFP we announced on 21 October 2015 regarding the project of translating AAOIFI’s Sharia Standards from Arabic to French please find below the questions thus we received with its answers:
1. I understand from paragraph 3 that the « Contractor » is the « Service Provider ». Is this understanding correct?
The contractor is the institution or the party that will be obliged to the contract. If it is direct contracting the contractor himself is the service provider.
2. Is the Coordinator of the Editorial and Coordination Team appointed by AAOIFI? Is he a staff member of AAOIFI?
He is selected by AAOIFI; however it is not necessary to be a staff member. Each party shall appoint a qualified Project manager (“Translation Coordinator”) AAOIFI shall serve as such party’s primary liaison throughout the course of the Project including the Services. The Translation Coordinator shall be authorized by the respective party to answer all questions posed by the other party and convey all decisions made by such party during the course of the Project including the Services and the other party shall be entitled to rely on such information as conveyed by the Project Manager.
3. Are the other members of the Editorial and Coordination Team appointed by the Service Provider/Contractor?
Yes
4. The Editorial and Coordination Team shall attend the meetings of the Review Committee. What is the hierarchical position of the Team with respect to the Review Committee?
The review committee is reviewing and approving the translation of the Editorial Team.
5. The Translation Team, the Editorial and Coordination Team and the Review Committee include Sharia Scholars, Islamic Finance experts, Legal experts and Translators. Could a member of one structure be also in another structure, could for instance a Shari’a Scholar be at the same time in the Translation Team and the Review Committee? The answer to this question is important to assess properly the cost of the resource persons who will be involved in the project.
The review committee will not include any member of the translation team, however less than 30% of the committee can include members from other structures.
6. Would there be a need to organize meetings with AAOIFI which involve the travel of members of the teams to AAOIFI headquarters at the cost of the service provider?
The coordination will be managed by coordinators of each party. We don’t expect periodic meeting schedule. However, conference calls will be used instead unless it is needed.
7. Is it possible for a translation team member to be part of the list provided by 2 different contractors (service providers)?
Yes it is possible. The team members can be listed in different contractors’ proposals, however the contract should be signed with one contractor that will be obliged to the terms and conditions of the contract.
8. We understand that our scope of work is limited to the translation of AAOIFI Standards from Arabic to French. However, are we required to provide a glossary of key terms in English as well? (Sections 4.1 and 4.4).
Since the translation is from Arabic to French, the glossary of key terms in French is required.
9. Just for clarification purposes, the editorial and coordination team – as per section 4.3 – comprises of a project coordinator (also mentioned in the RFP as translation coordinator as per section 2.3). This project/translation coordinator – appointed by the contractor – will coordinate with AAOIFI through their own translation coordinator? (Sections 2.3 and 4.3).
Yes, the coordination will be between the coordinators of both sided (AAOIFI & the contractor)
10. Should the review committee consist of a minimum of 6 members (4 Sharia Specialists + 2 Islamic Finance experts) or a minimum of 4 members (2 Sharia Specialists + 2 experts both in Sharia and Islamic Finance)? (Section 4.5).
The review committee should include 6 members. The review committee should include at least four specialists in the Shari’a having excellent command over Arabic and French languages, as well as, Islamic finance and may also include up to two experts in Islamic finance and banking having understanding of Arabic language and excellent command over Islamic finance and banking, as well as, French language.
11. Is it possible for a translation team member to be also listed amongst the editorial and coordination team or the review committee? (Sections 3.1, 4.3 and 4.5).
Yes it is possible, but they shouldn’t represent more than 30% of the review committee.
Please be reminded that, proposals must be received at AAOIFI at the address specified in section 4.8 no later than 20th November 2015, 3:00 pm Manama time.

Les principales normes Charia de l’AAOIFI avaient été partiellement traduites en français pour la première fois en 2011 à l’initiative de la Commission Finance Islamique de Paris EUROPLACE, composée d’avocats, banquiers et experts de la finance islamique, y compris les principaux conseils en charia (COFFIS, CIFIE).
Les « Normes Charia de l’AAOIFI en Français–Volume 1 » rassemblent les 20 principales normes Charia de l’AAOIFI et ont été officiellement validées par l’AAOIFI.
